These Terms of Service (“Terms”) govern your access to and use of the websites, content, products, and related services provided by Azalia’s Way LLC (“Azalia’s Way LLC,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Notice. If you do not agree to these Terms, you may not use the Services.

You may not use the Services if you are under 18 years of age or if you are prohibited from doing so under applicable law.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Services after any changes become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree that you will not:

• Use the Services in any way that violates any applicable law or regulation
• Use the Services to transmit, distribute, or store material that is unlawful, harmful, defamatory, obscene, harassing, or otherwise objectionable
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, or any server, computer, or database connected to the Services
• Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our prior written permission

We reserve the right to suspend or terminate your access to the Services if we believe you have violated these Terms.

Some parts of the Services may require or allow you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information as necessary
• Maintain the security of your login credentials and not share them with anyone else
• Notify us immediately if you suspect any unauthorized use of your account

You are responsible for all activities that occur under your account.

We may operate one or more SMS or MMS text messaging programs (the “Text Messaging Programs”) in connection with the Services.

By opting in to receive text messages from Azalia’s Way LLC, you agree that we may send you text messages to the mobile phone number you provide. These messages may include:

• Account or service-related notifications
• Appointment or event reminders
• Customer support communications
• Marketing or promotional messages, where allowed by law and your preferences

Message frequency may vary based on your interactions with us.

By providing your mobile phone number and affirmatively opting in to receive text messages from us (for example, by checking a box, clicking a button that references text messages, texting a keyword to our number, or otherwise clearly indicating your consent), you:

• Confirm that you are the owner or authorized user of the mobile phone number you provide
• Consent to receive recurring SMS and MMS text messages from us at that number
• Understand that messages may be sent using an automatic telephone dialing system or similar technology, where permitted by law

Your consent to receive marketing text messages is not a condition of any purchase.

You can opt out of marketing or promotional text messages at any time. To stop receiving such messages, you may:

• Reply “STOP” to any text message you receive from us, or
• Contact us at jasmine@azaliaswayllc.com and request to be removed from our text messaging lists

After you opt out, you may receive a final confirmation message. You may still receive non-marketing, transactional messages as permitted by law (for example, messages regarding your account or ongoing services), unless you separately request that we stop those where allowed.

Message and data rates may apply. You are responsible for any charges from your mobile carrier that may result from our text messages, including data and roaming charges.

Mobile carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your mobile service provider and is outside our control.

You agree to provide an accurate mobile phone number and to promptly notify us if your number changes or you no longer own or control the number you provided. This helps us avoid sending messages to the wrong person.

If you purchase products or services through the Services:

• You agree to provide current, complete, and accurate billing and account information
• You authorize us and our payment processors to charge your chosen payment method for any purchases you make

Pricing, availability, and descriptions of products or services are subject to change without notice. Any refund or cancellation policies will be described at the point of sale or in separate written terms. Where not specified, refunds are granted at our sole discretion, subject to applicable law.

All content and materials included in or made available through the Services, including text, graphics, logos, images, software, and the compilation thereof, are owned by Azalia’s Way LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, nonexclusive, nontransferable, revocable license to access and use the Services for your personal or internal business use, in accordance with these Terms. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services, except as expressly permitted
• Use any trademarks, logos, or trade dress appearing on the Services without our prior written consent

If you submit, upload, or otherwise make available any content (including comments, reviews, posts, or other materials) through the Services (“User Content”), you grant Azalia’s Way LLC a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform such User Content in connection with operating and providing the Services.

You represent and warrant that:

• You own or control all rights to your User Content, and
• Your User Content does not infringe, misappropriate, or violate the rights of any third party or any applicable law

We reserve the right, but are not obligated, to remove or modify any User Content that we consider to be unlawful, offensive, or otherwise inappropriate.

The Services may contain links to third-party websites, apps, products, or services that are not owned or controlled by Azalia’s Way LLC. We do not endorse or assume any responsibility for any third-party sites or services.

If you access any third-party site or service from the Services, you do so at your own risk and you understand that these Terms and our Privacy Notice do not apply to your use of such sites or services.

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Azalia’s Way LLC disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that:

• The Services will be uninterrupted, secure, or error free
• Any defects will be corrected
• The Services or any information obtained through the Services will be accurate, reliable, or complete

You assume all risk for any use of or reliance on the Services and any content available through the Services.

To the fullest extent permitted by law, Azalia’s Way LLC and its owners, directors, employees, contractors, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Services, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:

1. The amount you paid to us for the Services in the twelve months before the event giving rise to the claim, or
2. One hundred US dollars (100 USD)

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the above limitations will apply only to the extent permitted by law.

You agree to indemnify, defend, and hold harmless Azalia’s Way LLC and its owners, directors, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights or any applicable law

These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the state in which Azalia’s Way LLC is organized or primarily operates, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue or modify the Services. Upon termination, all provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.

These Terms, together with any other policies or terms referenced in them (including our Privacy Notice), constitute the entire agreement between you and Azalia’s Way LLC regarding the Services and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
